Actions Related to Special Waste Amendment (Scotland) Regulations 2004
- Ensure that waste is correctly stored so as to meet the requirements of the Duty of Care Regulations. Do not mix different types of special waste and ensure that special waste is properly segregated from other waste types. One item of special waste in a skip of household waste will require the whole skip to be treated as special waste. See Practical Waste Management Storage facilities and equipment
- Select a waste disposal contractor authorised to transport special waste and check their registration documents.
- Obtain a copy of the Waste Management Licence/permit for final destination of your waste and satisfy yourself that this site is authorised to process your waste.
- Obtain a Consignment Note and unique code from SEPA. Often the waste carrier will do this on your behalf as part of their waste collection service. The 5 part document should be completed as follows:
- Complete parts A and B on all 5 copies of the Consignment Note and enter the SEPA code number on each copy.
- Send one copy of the Consignment Note to the SEPA office for the place to which the consignment of waste is to be transported. The Consignment Note should reach the SEPA at least three working days and no more than one month prior to the movement of the consignment. Often the waste carrier will do this on your behalf as part of their waste collection service
- Get the carrier who collects the waste to complete part C on the four remaining copies of the Consignment Note.
- Complete part D on the four remaining copies. Keep one copy and pass the three remaining copies of the Consignment Note to the carrier.
- The carrier will give the three remaining copies to the consignee (the person to whom the waste is being transported). The consignee will complete part E on all three copies, retain one copy, pass one copy to the carrier and send the final copy to the SEPA office for the area.
- Part B of the Consignment Note requires a description of the waste. If the consignment of waste is made up of more than one waste type, separate sheets should be attached for each waste type detailing all the information required in Part B. The Consignment Note number should be included on each sheet. When completing Part B the following points should be noted:
- B2. The European Waste Catalogue six digit code(s) for the waste should be entered. Further information on EWC codes here
- B6. The concentration can be given as limit values so long as the nature of the hazard and management requirements for the waste do not vary across the range of concentrations.
- B7. Identify the relevant hazard code(s) for the waste as given in the Special Waste Regulations 1996.
- B8. Use an appropriate generic term to describe the process giving rise to the waste (e.g. waste chemicals from research).
- Ensure that the Consignment Note includes sufficient information to comply with the requirements of the Duty of Care by adding information concerning authorised persons or complete a separate Transfer Note.
- A copy of the Consignment Note should be retained for a minimum of 3 years from the date on which the transfer occurred.
